The information on this Site is updated from time to time. However, we hereby
exclude any warranties (whether expressed or implied), as to the quality, accuracy,
efficacy, completeness, performance, fitness for a particular purpose of the
Site or any of its contents, including (but not limited) to any curriculum
vitae contained within the Site.
Disability Jobsite shall not be responsible for any failure to provide the Services,
or unavailability of the Site, as a result of circumstances beyond its reasonable
control but the Client accepts that it shall still be responsible for the payment
of the Fees as if the Services had been properly provided.
We will not be liable for any damages (including, without limitation, damages
for any consequential loss or loss of business opportunities or projects,
or loss of profits) howsoever arising and whether in contract, tort or otherwise
from the use of or inability to use the Site, or any of its contents,
or from any action or omission taken as a result of using the Site or any such
contents.
We make no warranty that the contents of the Site are free from infection by
viruses or anything else which has contaminating or destructive properties
and shall have no liability in respect there of.
You should note that certain links on the Site lead to resources located on
servers maintained by third parties over whom we have no control and accordingly
we accept no responsibility or liability for any of the material contained
on those servers.
Where part of the Site contains advertising and other material submitted to
us by third parties please note that those advertisers are responsible for
ensuring that material submitted for inclusion on the Site complies with all
legal requirements. Although acceptance of advertisements on the Site is subject
to our terms and conditions which are available on request, we do not accept
liability in respect of any advertisements. All liability is excluded
to the extent permitted by law including any implied terms.
These Conditions are deemed to be fully read, understood and accepted by the
Client. No variation or alteration to these Conditions or any representations
about the Services shall have any effect unless expressly agreed and confirmed
in writing by a director of Disability Jobsite.
Disability Jobsite shall be entitled at anytime without notifying the Client to
make changes to the Services which are necessary to comply with any applicable
security or other statutory requirements and shall determine the manner in
which the Services are provided.
All copyright, database rights and other intellectual property rights in the
site and the material available on the site belongs to Disability Jobsite or its
third party suppliers. Use of the site does not give you any proprietary rights
in such materials.
Any intellectual property, ideas, concepts, know-how or techniques developed
by Disability Jobsite or obtained during the execution of the Services will
be owned exclusively by Disability Jobsite.
With effect from the Start Date Disability Jobsite shall provide the Services
for the Term subject to the provisions of these Conditions.
Disability Jobsite shall not be responsible for any failure to provide the Services,
or unavailability of the Site, as a result of circumstances beyond its reasonable
control but the Client accepts that it shall still be responsible for the payment
of the Fees as if the Services had been properly provided.
Clause 1: The Client accepts that: Disability Jobsite shall not be liable for
any failure to provide the Services (or any part thereof) as a result
of the Client's failure to comply with the Contract;
if any quota of Services which are to be used with any period of time specified
in the Service Agreement are not used within that period of time; then in each
case the Client shall still be responsible for the full payment of the Fees
as if the Services had been properly and fully provided (and for the avoidance
of doubt Disability Jobsite shall not be liable for providing any unused Services
and such Services may not be carried over to any subsequent period).
The Client: authorises Disability Jobsite to accept instructions in relation to
the Services (without having to refer to the Client) from any person agreed
between Disability Jobsite and the Client to be an authorised user;
* accepts that Disability Jobsite shall not be responsible
for any breach of this Agreement, any delay in performance of the Services
or defect or error in the Services which arises as a result of Disability
Jobsite accepting instructions from such an authorised user;
* shall be responsible for all acts and omissions of any
such authorised user as if they were acts or omissions of the Client.
Price Match
1. Quotations must include the other diversity sites. 2. Price match is only on provision of a written quote. 3. Quote obtained must be from an job board. 4. Offer applies to new bookings only. 5. Offer applies to comparable service, on a like for like basis.
The Client agrees to provide Disability Jobsite, in such a format as Disability Jobsite
may request, any information, design work, artwork and logos necessary to enable
Disability Jobsite to provide those Services.
Disability Jobsite shall not be obliged to provide those Services until the Client
has supplied it with the information, design work, artwork and logos necessary
to provide those Services. Such information shall be supplied within 10 days
of the date of the Contract, or such later date as agreed by Disability Jobsite.
If the Client fails to supply Disability Jobsite with the information then clause
1.0 shall apply.
Disability Jobsite shall make such modifications to any Advertisement as are reasonably
requested by the Client provided that Disability Jobsite reserves the right
to charge at the rate of 25 Pounds Sterling per hour for the time involved
in connection with such modifications.
Advertisements will become live on the Site only when the Client has approved
the design work, set-up, artwork and logos. If a Client has been authorised
to approve any design work, artwork or logos on behalf of the End Client, then
the Client must provide proof of this in writing to Disability Jobsite on
request.
The Client agrees Disability Jobsite from time to
time will use their logo in its promotional campaign as part
of its awareness campaign. The client reserve the right to
request their information and logo to be removed.
The Client accepts that Disability Jobsite cannot guarantee the
number of occasions on which any individual Advertisement appears
on the Site and that no obligations are imposed on Disability
Jobsite in this regard.
Advertisements placed on the Site may be cancelled and removed following written
notification from the Client and will be charged for the Term as described
in the Contract as if such cancellation had not occurred and the Services had
been properly supplied in full.
Disability Jobsite has the right at its sole discretion to decline to publish
or omit, suspend or change the position of any Advertisement accepted by it.
Disability Jobsite may refuse, withdraw, or require to be amended, any artwork,
materials or copy for or relating to an Advertisement which is illegal, immoral,
obscene or offensive or so as to comply with the legal or moral obligations
placed upon Disability Jobsite or the Client or to avoid infringing a third party's
rights or any statutory or regulatory requirements.
Unless otherwise agreed by us in writing, payments are due within 28 days of
our invoice. VAT is payable on all amounts invoiced, at the applicable rate.
We may charge interest at 2% above the base rate of Barclays Bank from time
to time on all overdue payments. |
